LIMITED SERVICE WARRANTY Offeror of Warranty. This limited service warranty is only made by the DC location that performed the original Services which is identified on your receipt and/or invoice ("Original DC"). This limited service warranty may also be honored by another participating DC in Lyft's sole and absolute discretion. This limited service warranty is only made by Lyft Center, Inc., and is not made by Lyft, Inc. or any other affiliate of Lyft. Warranty Period. For maintenance and repair Services: We will reperform any defective Services and will repair and/or replace any defective parts within thirty (30) days from the date of such Services, provided that you must bring the car to the Original DC for inspection during such 30-day period. Lyft will make the decision, in its sole discretion, on whether the respective Services and parts were defective. For collision Services: We will reperform any defective Services within the duration of your ownership of or rental interest in, your vehicle and will repair and/or replace any defective parts within the warranty period as provided by the manufacturer of the defective part; provided that you bring the car to the Original DC for inspection within seven (7) days from becoming aware of such defect. Lyft will make the decision, in its sole discretion, on whether the respective Services and parts were defective. The maintenance, repair, and collision Services for purposes of this Agreement are deemed to be the services that are customarily understood to be such services in the motor vehicle business in the United States. What is Covered. This limited service warranty only extends to the motor vehicle and vehicle owner or lessee identified on the receipt and/or invoice. This limited service warranty only covers the Services identified on the receipt and/or invoice and which have been paid in full at the time the warranty is requested. If the oil filter or fluids fail to perform properly during the warranty period, the Original DC may, in its sole discretion and expense, install a new oil filter and refill any fluids shown on the original receipt and/or invoice. The Original DC may also, in its sole discretion and expense, conduct any further investigation as that DC may deem necessary to determine the cause of any claimed failure of the Services. Exclusions to this Warranty. This limited service warranty does not apply, as determined by the Original DC in its sole and absolute discretion, if (a) there were any repairs, modifications, or other adjustments made to the motor vehicle that affects the Services and/or parts or products that are claimed to have failed, (b) there was any misuse of or damage to the Services and/or parts or products that are claimed to have failed, including without limitation, using such parts or products in a manner in which they are not intended to be used, (c) the Service documentation indicates that you declined to authorize specific labor, parts, or services required for satisfactory performance, (d) you fail to preserve any parts or products you claim are defective and provide them to the participating DC, or (e) the manufacturer of an applicable part or product does not warrant that part or product, the manufacturer warranty is no longer in effect, the particular defect is not covered by the manufacturer's warranty, or an exclusion to the manufacturer's warranty applies. Subcontractors. If we explicitly indicate that certain Services are provided by a subcontractor, you will receive any warranty such subcontractor provides to Lyft, and such Services will not be covered by the Service warranty as indicated in this Section above. DISCLAIMER OF WARRANTIES THE FOREGOING LIMITED SERVICE WARRANTY IS YOUR SOLE AND EXCLUSIVE REMEDY AGAINST LYFT ARISING OUT OF OR RELATING TO THE SERVICES PROVIDED TO YOU BY LYFT. THE LIMITED SERVICE WARRANTY SHALL NOT APPLY TO ANY MODIFICATION OR ALTERATION OF THE SERVICES, PARTS, OR PRODUCTS BY YOU OR ANY THIRD PARTY AND SHALL ONLY APPLY TO THE EXTENT THERE IS AN APPLICABLE MANUFACTURER'S WARRANTY IN EFFECT FOR A DEFECTIVE PART OR PRODUCT AND ANY SERVICES, PARTS, OR PRODUCTS PROVIDED TO YOU BY A DC ARE USED BY YOU IN STRICT CONFORMANCE WITH THE INTENDED USE OF SUCH SERVICES, PARTS, OR PRODUCTS AS DETERMINED SOLELY BY THE DC HONORING THE LIMITED SERVICE WARRANTY AND THE MANUFACTURER OF THE APPLICABLE PARTS OR PRODUCTS. ALL OTHER WARRANTIES ARE SPECIFICALLY EXCLUDED AND DISCLAIMED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, WARRANTY OF NON-INFRINGEMENT, AND ANY WARRANTY ARISING BY STATUTE, OPERATION OF LAW, COURSE OF DEALING, PERFORMANCE, OR USAGE OF TRADE.
